Abstract

The background to this research is due to a request for cancellation of freehold title number 6222/Cilandak Barat in the name of Latifah Libriany. The reason for the cancellation is because of Decision number 302/G/2021/PTUN-JKT which cancels freeholf title number 6222/Cilandak Barat in the name of Latifah Libriany. Because of this, the aim of this research is to find out the following things: (1) Find out the reasons for filing an annulment lawsuit at the Jakarta PTUN; (2) Know the judge's considerations in deciding cases; (3) What is the follow-up to Decision number 302/G/2021/PTUN-JKT. The research method used in this research is normative-empirical legal research. The approaches used are the statutory approach and the case approach. This research was carried out by collecting and analyzing secondary data or library materials consisting of primary legal materials and secondary legal materials. The results of research carried out by researchers regarding the cancellation of freehold title number 6222/Cilandak Barat in the name of Latifah resulted in the following conclusions: (1) The basis for the cancellation lawsuit was because of the civil decision number 1053/Pdt.G/2021/PN.Jkt.Sel, which states Iswandono as the owner of the object of dispute; (2) The civil judge's consideration in deciding the land ownership dispute between Iswandono and Latifah was the existence of a statement letter made by Suripta and because of the unlawful act committed by Latifah; (3) The consideration of the Panel of Judges at the Jakarta civil court focuses on the civil decision number 1053/Pdt.G/2021/PN.Jkt.Sel which is the basis for filing the lawsuit for annulment; (4) Follow-up to the decision of the Jakarta State Administrative Court number 302/G/2021/PTUN-JKT, namely the cancellation of freehold title number 6222/Cilandak Barat in the name of Latifah, so the ownership now belong to Iswandono.
