Abstract

Issues of "Surat Ijo" to residents occupying Surabaya City Government assets has garnered significant attention due to the perceived legal injustices affecting some residents. This phenomenon has hindered land governance in Surabaya and remains unresolved to date. This research aims to explore the history and challenges surrounding the implementation of Surat Ijo in Surabaya, as well as to provide recommendations based on applicable regulations. The normative- empirical legal method is employed, utilizing legislative, conceptual, and sociological approaches through interviews with stakeholders involved in the issuance of Surat Ijo. The findings of this research reveal that the Surat Ijo originated from privately owned lands, either previously purchased by the Surabaya gemeente or still held by private landowners. In 1997, Ministry of Agrarian decree granted land rights to the Surabaya City Government, legitimizing their control over these former lands. Recommendations for conflict resolution include granting long-term Building Rights (HGB) above the current leasehold rights (HPL) of the Surabaya City Government, or converting the Surat Ijo into private ownership under Surabaya City Regulation No. 16/2014.
