Abstract

The Land Acquisition Project that occurred in Kapanewon Temon for the construction of Yogyakarta International Airport, Yogyakarta International Airport Railway Line, and Community Relocation used up a lot of village land. Village land that should have been released using an exchange mechanism was instead replaced using money. The responsibility for providing replacement land for village land that should have been carried out by the Agency Requiring Land, instead shifted to the village government. After passing the deadline for replacement land procurement, which was 2 years, the government was certain to have failed to guarantee the existence of village assets according to PMDN No. 1 of 2016. This study uses the sequential exploratory method to explain the replacement land procurement for village land by reviewing qualitatively descriptively from the policy side to return village land and the implementation of existing regulations as well as the progress of the sustainability of replacement land procurement for village land as proof of failure in the realization of the program through statistical percentage diagrams of failure. In addition, it reviews the obstacles as the reasons for the failure of the replacement land procurement for village land and various problems and the absence of solutions from the replacement land procurement committee or the local government. The results of this study are: first, two policies were obtained in resolving the search for replacement land, namely the mechanism for procuring replacement land for village land before 2021 carried out by committee 9 consisting of the Kulon Progo Regency Government apparatus and the Kulon Progo Regency Land Office, and the scheme for the mechanism for procuring replacement land for village land in the Kulon Progo Regency Regent Regulation No. 33 of 2021 concerning Technical Instructions for the Implementation of Land Procurement for Replacement of Village Land. The mechanism scheme is prioritized to be implemented by the village government. Second, regarding the progress of the implementation of the search for replacement land, the researcher divided the status of replacement land rights into 4 (classes) categories to show the extent to which the regional government and village government have succeeded in returning village assets to become usage rights in the name of the village. Third, the researcher describes various obstacles and problems that cause failures that are felt in the implementation of land procurement to replace village land, both from the lowest level, namely the village to the level of policies that are considered detrimental.
