Abstract

This research is motivated by the existence of a land dispute problem in Cipanas Village, Cipanas District, Lebak Regency between Siti Supiah and Totong Khomarudin. In this case, it was based on an objection from Siti Supiah based on the Deed of Sale and Purchase Number 30 of 1994 against the Certificate of Ownership Number 1447 of 2018 issued through the Complete Systematic Land Registration Program (PTSL). The objection problem is that the AJB of 300 m2 is included in the SHM of 819m². To resolve this problem, there is an alternative solution through mediation. The purpose of this study is to find out the following things: (1) To find out the factors causing the dispute between Siti Supiah and Totong Khomarudin (2) To find out the implementation of the process of handling and resolving the dispute between Siti Supiah and Totong Khomarudin (3) To find out the results and solutions provided by the Lebak Regency Land Office through mediation in resolving the land ownership dispute between Siti Supiah and Totong Khomarudin. The research method used by the researcher in this study is the empirical legal research method with a descriptive approach. This research was conducted by collecting data, reducing data and analyzing data and providing conclusions. The data sources in this study are primary data and secondary data. Data collection techniques are interviews and document studies. The results of the research conducted by the researcher on the minutes of the meeting documents and the interviews with officials/staff at the Land Office of Lebak Regency related to mediation. The conclusions in this research are as follows: (1) The factors causing the dispute are the failure to pay for the land based on the Sale and Purchase Agreement (AJB) included in the certificate, which leads to objections regarding the issuance of the Land Ownership Certificate (SHM). (2) The process of handling and resolving disputes through mediation at the Land Office of Lebak Regency refers to the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning Handling and Resolution of Land Cases Article 6. (3) The solution provided by the Land Office of Lebak Regency is in the form of a Peace Deed made in the presence of and by the head of the Land Office of Lebak Regency. The content of the Peace Deed states that Totong Khomarudin, as the right holder based on SHM No. 1447/Cipanas/2018, is willing to relinquish part of the ownership rights of Siti Supiah.
