Abstract
The Government of Pangandaran Regency has successfully obtained (Hak Pengelolaan or HPL) Certificates over 4 (four) land parcels located within the coastal boundary area of Pangandaran Beach. As the holder of HPL, The Pangandaran Regency Government has the authority to manage and utilize the land in accordance with Article 7 paragraph (1) of Government Regulation Number 18 of 2021. The utilization of these HPL lands is intended to be optimized to support tourism development and increase the region’s Local Own-Source Revenue (Pendapatan Asli Daerah or PAD). However, the management and utilization of the HPL land have not yet been implemented optimally. This research examines the obstacles encountered in the management of HPL land and the adequacy of the authority granted to the regional government. This study uses a qualitative method with a descriptive approach to explore the phenomenon related to the management and utilization of HPL land by the Pangandaran Regency Government. The findings show that although several policies have been issued concerning cooperation in the utilization of HPL land, their implementation remains suboptimal. The main issues identified include the absence of a specific regional regulation that comprehensively governs the utilization of HPL land; the lack of established tariffs and/or Annual Mandatory Contributions (UWT), which results in the absence of revenue contributions to the region; and the overall inefficiency of land management practices. Nevertheless, several efforts have been made by the local government to address these challenges, including the issuance of regent decrees concerning cooperation mechanisms, which subsequently led to the issuance of Building Use Rights Certificates (Hak Guna Bangunan or HGB) over HPL for third parties; the use of independent appraisers to determine tariffs and/or UWT in the absence of clear regulations; and the involvement of several regional work units (SKPD) to manage the land utilization according to their respective duties and functions. Overall, the authority for managing and utilizing HPL land in Pangandaran Regency still requires significant improvement, particularly in terms of the quality and quantity of human resources involved, in order to achieve optimal and effective utilization of HPL land. Such improvements are also necessary to minimize the potential for future legal, administrative, or social problems.
