Abstract

The Yogyakarta City Government organizes small-scale land acquisition for the development of Public Open Green Spaces (RTHP) and Public Facilities (Fasum) through the Land and Spatial Planning Office (Dinpertaru) of Yogyakarta City. The development is carried out directly without the determination of location, through a buying and selling mechanism between Dinpertaru and the landowners. In the provision of compensation for the land acquisition, Dinpertaru only compensates for the land itself and provides no compensation for buildings. Therefore, this study aims to: a) examine the mechanism of small-scale land acquisition in Yogyakarta City; b) assess the appropriateness of compensation provided to landowners in small-scale land acquisition in Yogyakarta City; and c) analyze the agreement process achieved during the small-scale land acquisition in Yogyakarta City. This study employs a qualitative method with a descriptive approach. The results of the study show that: a) the stages of small-scale land acquisition in Yogyakarta City include the need for RTHP and Fasum, which originate from proposals by various parties, followed by the release of land rights and payment; b) the number of land proposals is disproportionate to demand, so Dinpertaru prioritizes proposals using a scoring system while considering the need for RTHP, which accounts for 20% of the total area of Yogyakarta City, additional Fasum availability, and alignment with spatial planning; c) Dinpertaru uses the services of a Public Appraiser to assess compensation for the acquired land, in accordance with Government Regulation Number 39 of 2023; d) Dinpertaru informs landowners that the Yogyakarta City Government will only purchase the land and not compensate for buildings, which are valued at 0 rupiah, thus the implementation of compensation is not entirely in accordance with Government Regulation Number 39 of 2023; and e) there is transparency between Dinpertaru and landowners regarding the compensation, which leads to voluntary land sales and mutual agreement.
