Abstract

Land disputes are one of the complex issues that frequently occur in Indonesia. To ensure legal certainty regarding land rights, land registration becomes an important step, where the situational map plays a role as an administrative document depicting the boundaries and physical condition of the land parcel, especially in the case of a provisional certificate. This study aims to analyze the position and validity of the situational map issued by the Ministry of Home Affairs, Directorate General of Agrarian Affairs, as well as examine its strength as evidence in the process of proving land rights. The method used is a combined legal research approach, both normative and empirical, with approaches to legislation, case law, and conceptual frameworks. The case study focuses on Decision No. 12/G/2024/PTUN.PLG. The research findings indicate that the situational map can have a legal position as supporting evidence that can clarify the disputed object. In judicial practice, the situational map is used to assess the location, boundaries, and physical control of the disputed land, and can contribute significantly to the judge's consideration.
