Abstract

Land redistribution is one of the main programs in agrarian reform aimed at providing fairer access to agricultural resources, particularly for small-scale farmers. The implementation of land redistribution, as part of agrarian reform policy, is intended to ensure legal certainty and agrarian justice for communities, especially landless or land-poor farmers. However, various problems are still encountered in its implementation, one of which is the violation of the prohibition on the transfer of redistributed land rights as stipulated in Article 14 paragraph (4) of Government Regulation No. 224 of 1961. A case study in Oko-Oko Village, Pomala District, Kolaka Regency, reveals that some recipients of redistributed land transferred their rights before the 10-year restriction period had elapsed, and such transfers were even formally approved by the local land office and legalized through a deed by the Land Deed Official (PPAT).This study aims to examine the effectiveness of implementing the prohibition on the transfer of redistributed land rights at the local level, investigate the factors contributing to the occurrence of such practices in violation of the law, and analyze the legal implications on the sustainability of the land redistribution program and the goals of agrarian reform. This research employs an empirical legal research method with a qualitative approach, describing socially constructed facts such as community perspectives and understanding of law and justice. The findings indicate that there are several factors behind the approval of the transfer of redistributed land rights by the Kolaka Land Office before the 10-year restriction period.
