Abstract

This study examines the compensation settlement mechanism in land acquisition for the development of the National Sports Week (PON) XX venue in Minabua Village, Mimika Baru District, Mimika Regency, Central Papua Province. Land acquisition for public purposes must fundamentally uphold the principles of justice and legal certainty for affected communities. In this case, 17 households were entitled to receive compensation, but as of the time of the research, only 11 households had received payments. Meanwhile, the remaining 6 households had not received compensation due to the incomplete submission of administrative requirements, particularly those related to land ownership and control. This study employs a qualitative method with a descriptive approach. Data were collected through in-depth interviews, field observations, and document studies involving planning documents and relevant policies. The research findings indicate that the land acquisition and compensation process in the area encountered several obstacles, including a significant delay in the preparation of planning documents—lasting nearly four years (2019–2023), limited public outreach, weak inter-agency coordination, and a mismatch between community expectations and the compensation values determined by authorities. One alternative resolution applied by the government was the consignment mechanism, whereby compensation funds were deposited in court. However, this solution has not fully met the expectations of the affected community, especially those whose land rights have not yet been administratively verified. The study recommends the need to improve transparency, accelerate the administrative verification process, provide legal assistance to the community, and strengthen deliberative processes (musyawarah) as a means of resolution that upholds the principles of justice, legal certainty, and humanity. The findings of this research are expected to serve as a reference in formulating land acquisition policies in regions with complex social and legal characteristics such as Papua.
