Abstract

Economic growth and ecosystem sustainability are pressing global issues in the pursuit of achieving the Sustainable Development Goals (SDGs). To align both objectives, environmentally conscious business licensing is essential to account for the environmental impacts of business activities. In Indonesia, business licensing is implemented based on a risk-based approach, where one of the requirements for Micro and Small Enterprises (MSEs) is to obtain a spatial utilization permit through a unilateral self-declaration. In Pasuruan Regency, the rapid growth of MSEs has triggered various spatial planning issues, such as the use of green open spaces and agricultural land for business purposes without regard to the Detailed Spatial Plan (RDTR), which, if left unchecked, could lead to spatial use violations. Therefore, this study aims to assess the conformity of spatial utilization permits submitted unilaterally through self-declarations by MSEs with the RDTR, and to examine the implementation of spatial use control in Pasuruan Regency. This research employed a mixed-methods approach. Data were collected through document analysis, field surveys, and interviews. The research population consisted of self-declarations submitted for the KRK in 2024 in areas covered by the RDTR and integrated with the Online Single Submission (OSS) system, using saturated sampling. Informants were selected through purposive sampling. Spatial analysis was used to assess the conformity of business locations with the RDTR, and thematic analysis was applied to interview data to evaluate the implementation of spatial use control. The research results show that 23 out of 40 locations did not comply with land use regulations, 19 out of 40 locations did not comply with spatial utilization intensity provisions, 31 out of 40 locations did not conform to building layout regulations, and 3 out of 40 locations did not meet the specific provisions for LP2B (Sustainable Agricultural Land). The most frequent violations were related to building layout regulations. These discrepancies were primarily caused by mismatches between business activity types and designated spatial functions, differences in base map usage, inaccuracies in zoning determination, and building regulation violations. Meanwhile, spatial control implementation in Pasuruan Regency has not been optimal due to limited human resources, the absence of regional regulations on spatial control, technical obstacles during surveys, and conflicts of interest. Proposed solutions include increasing community participation, drafting regional regulations on spatial control, and continuous outreach to business actors. Furthermore, enforcement actions have not yet reached the sanction stage due to the lack of a legal framework for prosecution.
