Abstract
This study discusses the implementation of compensation for village land in the land acquisition project for the construction of the Jogja–Solo Toll Road, specifically in Purwomartani Village, Kalasan Subdistrict, Sleman Regency. The main focus is on analyzing the compensation implementation mechanism based on Yogyakarta Special Region Governor Regulation No. 24 of 2024 and identifying obstacles and solutions in its practice. The special authority of the Special Region of Yogyakarta (DIY) in land matters results in different mechanisms for land acquisition involving village land in DIY compared to other regions. The difference lies in the absence of land transfer from the owner, the Sultanate, meaning that the village land can be used for toll road construction but is not transferred. The method used was descriptive qualitative, through a study of regulatory documents and in-depth interviews with relevant agencies, such as the DPTR DIY, the Sleman Land Office, the Kalurahan Government, and affected residents. This study describes and provides an overview of the research object, namely the compensation process for village land due to the construction of a toll road. In this study, the descriptive qualitative method was used to identify and describe the procedures for implementing compensation for village land, the challenges faced during implementation, and the efforts that can be made by relevant parties to overcome these challenges in the compensation process. The results of the study indicate that the implementation of compensation for village land differs from the general land acquisition mechanism. There is no transfer of land rights, but rather a leasing mechanism is implemented, involving the return of land rights from the village to the Sultanate, followed by the issuance of the Serat Palilah, appraisal of lease values, and the provision of compensation (pisungsung). The main challenges include delays in coordination with the Sultanate, legal uncertainty at the outset of the project, and economic impacts on farmers. Solutions that emerged include the formation of an inter-agency coordination team, the development of procedures based on DIY's special status, and the economic empowerment of affected residents. This study emphasizes the importance of synchronizing national regulations with local characteristics in land acquisition in special regions like DIY.
