Abstract

The construction of the Serang–Panimbang Toll Road, as part of the National Strategic Project, crosses a forest area in Lebak Regency, where some of the land has been controlled by the community for generations without formal land rights. This study aims to analyze the legal status of the land, the community's land rights, the land acquisition process, emerging problems, and efforts to resolve them. The research location is focused on Muaradua Village and Pasirgintung Village, Cikulur District, Lebak Regency, which are affected by the Toll Road construction project where there is an overlap between community control and the status of the forest area. This research employed qualitative methods. Data collection techniques included interviews with relevant agencies and affected communities, as well as a review of documents and laws and regulations. Data analysis was conducted using descriptive-qualitative methods, with source triangulation to enhance data validity. The results show that there are land parcels controlled by the community located in the Limited Production Forest area and do not yet have formal rights. Problems that arise include land parcels that were only identified as being in the forest area after the field boundary delimitation and verification process, the absence of formal ownership evidence from the community, the non-involvement of the community controlling land parcels in the forest area in compensation discussions, discrepancies between factual control in the field and the legal status of the area, and the low level of community understanding of the regulations applicable to the land acquisition process. Resolution efforts refer to applicable regulations, where this is carried out through cross-agency coordination and the provision of compensation as part of the handling of social impacts in accordance with Presidential Regulation 62 of 2018 in conjunction with Presidential Regulation 78 of 2023.
