Abstract

This study explores the implementation of customary land redistribution programs in Biak Numfor Regency, Papua Province, focusing on two villages: Urfu and Sanumi. Customary land redistribution differs from state land redistribution as it requires more contextual and culturally sensitive approaches, especially considering the dominance of customary land tenure in Biak Numfor. The purpose of this study is to examine the processes and mechanisms of land redistribution carried out in the two villages, as well as the impact of this program on the roles and authority of traditional leaders. This research employs a qualitative method with a descriptive-historical approach. The study describes the stages of customary land redistribution, including the release of land rights by customary leaders, land inventory, mapping, and the issuance of land ownership certificates by the Biak Numfor Land Office. Data were collected through interviews, documentation, and literature studies, using both primary and secondary data sources. The findings indicate that the land redistribution programs implemented in Urfu in 2023 and in Sanumi in 2024 successfully provided land certificates to indigenous communities. However, the program also led to significant changes in the authority of traditional leaders. Prior to redistribution, they held full control over customary land (ulayat), but after certification in the name of individuals, their collective authority was diminished. This shift presents new challenges in preserving customary values while also creating opportunities for integrating national legal systems with local customary norms.
