Abstract

Land ownership conflicts often arise between communities, the government, and both private and state-owned enterprises (BUMN). PT Pertamina (Persero), as one of the state-owned enterprises (BUMN), has also encountered similar conflicts regarding land asset ownership. This research aims to outline the chronology of the land asset ownership conflict between the community and the Banyuasin Regency Government with PT Pertamina (Persero) in Banyuasin Regency, identify the primary causes of the conflict, and propose alternative solutions for addressing and resolving the issue. This research utilizes a qualitative method with a descriptive approach, collecting data through interviews, observations, and document analysis. The conflict originated with land control by the community since 1955, PT Pertamina (Persero) which acquired the land from PT Stanvac Indonesia in 1970, failed to extend the HGB that expired in 1980. Land administration was not managed until 2021, leading to increased community awareness and their efforts to fight for their land rights. The dominant causes of the conflict include disorganized land administration, overlapping land control and utilization, and the use of the land by the Banyuasin Regency Government for public purposes. Alternative solutions for handling and resolving this land asset ownership conflict may be found in Perpres No.62/2023, which focuses on the acceleration of agrarian reform. Resolving this conflict requires prompt action through effective collaboration between the involved parties to achieve a fair solution. Keywords: Agrarian Conflict, Land Ownership, Land Assets.
