Abstract

Land disputes are a recurring and complex issue in many regions of Indonesia, including Kubu Raya Regency. As a non-litigation alternative, mediation is one of the strategies implemented by the Land Office to resolve such disputes. This undergraduate thesis aims to examine the implementation of mediation in land dispute resolution at the Land Office of Kubu Raya Regency, to identify the internal and external factors that influence its effectiveness, and to formulate strategic recommendations for optimizing its implementation. This study adopts a qualitative descriptive approach, utilizing data collection methods such as interviews, observations, and document analysis. The analysis was carried out using SWOT and Gap Analysis tools. The results indicate that out of 58 land dispute cases recorded over the past two years, 31 were successfully resolved through mediation. Internally, the Land Office demonstrates strengths in its mediators’ understanding of land law and adherence to formal regulations. However, weaknesses such as limited mediator training and inadequate document management remain challenges. Externally, growing public awareness and national policy support provide opportunities, while the absence of parties and low legal literacy present ongoing threats. Based on these findings, the recommended strategies include improving mediator competence, enhancing digital documentation systems, and increasing legal literacy through outreach and education. Strengthening these aspects is expected to improve the institutional capacity of the Land Office in managing land disputes through a more adaptive and responsive mediation process.
