Abstract

This research analyzes land rights policies after flash flood disasters and spatial planning in Ternate City, especially in Kelurahan Rua. The flash flood caused unclear land ownership boundaries, loss of ownership evidence, and a change in land status from private ownership to state land or "destroyed land" due to the designation of the area as a disaster-prone zone. This condition prompted the local government and the Ternate City Land Office to implement a relocation policy for disaster victims to Kelurahan Jambula. This study aims to determine the land ownership status of the community affected by the flash flood in Kelurahan Rua and to understand the arrangement of land ownership carried out after the disaster. The research method used is descriptive qualitative, with the research location in Kelurahan Rua, Ternate City. Informants were selected purposively, including the Head of the Rights Determination and Land Registration Section of the Ternate City Land Office, the Head of the Survey and Mapping Section, the Head of the Housing, Settlement and Land Affairs Office, Kelurahan Rua village officials, and affected community members in Kelurahan Rua. The research results conclude that community members in the affected area (Kelurahan Rua) can no longer claim their land rights in the area, as it has been designated as a Red Zone in accordance with Mayoral Regulation Number 34 of 2021. The North Maluku Provincial Government has also issued Ternate Mayoral Regulation No. 34 of 2021, which regulates the construction of relocation houses for disaster victims based on the principles of equity and fairness in the land area and physical house provided.
