Abstract

Land acquisition issues for public purposes often result in residual land that is no longer functionally optimally utilized by its owner. Residual land becomes a crucial issue because at that time there were no explicit statutory provisions that regulated its handling in terms of the criteria for residual land that could be recommended for compensation and not. This study focused on residual land with an area of more than 100 m2 that emerged in the land acquisition activities of the Jakarta-Bandung High-Speed Rail construction project in Mengger Village, Bandung Kidul District, Bandung City. Therefore, this study is necessary. The research method used is qualitative with a descriptive approach. This study provides an overview of the compensation mechanism for residual land with an area of more than 100 m2, the criteria for residual land with an area of more than 100 m2, as well as the obstacles and solutions in the compensation process for residual land with an area of more than 100 m2. From the research results, it was found that the compensation mechanism for remaining land with an area of more than 100 m2 has consistently followed existing regulations such as Law No. 2 of 2012, Presidential Decree No. 71 of 2012, BPN Regulation No. 5 of 2012 and the Circular Letter of the Director General of Land Acquisition. Of the 16 remaining land plots with an area of more than 100 m2 that were found, it was found that 12 plots were recommended for compensation, 1 plot was not recommended for compensation, 3 plots were not recommended for compensation but buildings were recommended for compensation. The obstacles in providing compensation for remaining land with an area of more than 100 m2 are: (1) Difficulty in Coordination between the Remaining Land Study Team, (2) Incomplete administrative filing, (3) Differences in understanding of the form of compensation by the community. The solutions to overcome these obstacles are: (1) Strengthening coordination in resolving remaining land, (2) The parties have the right to immediately complete the files, (3) Providing educational understanding and scheduling a new meeting.
