Abstract

Population density drives the increasing demand for land for various purposes such as housing, economic activities, and public facilities. With land area remaining constant and demand rising, some communities resort to illegal occupation and construction, including building structures on land not intended for development, such as railway areas. These areas are not designated for residential or structural use. This study aims to analyze the conditions of land occupation and utilization along the railway in Tegalrejo Subdistrict and to examine PT KAI’s efforts in controlling such use. The research employs a mixed-method approach, combining empirical juridical studies with descriptive and spatial analysis. The findings show: 1) In RT 20, land occupation began with a fair relocation in the 1980s, including the provision of land ownership certificates (SHM). In contrast, RT 23 exhibits illegal occupation on PT KAI land. Other areas show inherited land occupation. Land in the Rumaja, Rumija, and Ruwasja zones is predominantly controlled by non-owners, with Rumaja and Rumija occupations violating Law No. 23 of 2007. Of the 123 plots, around 70% are certified, though some lie within restricted zones. Juridically, these certificates remain valid until officially annulled. 2) Land use is primarily for housing and economic activities, violating restrictions in Rumaja and Rumija zones, which must remain free from non-operational activities. In Ruwasja, land use is more flexible but still subject to railway safety regulations. 3) PT KAI employs persuasive approaches for regulation and has ceased rental systems in restricted zones.
