Abstract

The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) frequently faces challenges related to land mafia practices. According to land law expert Nurhasan Ismail, land mafias are networks that appear legitimate on the surface but conceal illegal actions that benefit perpetrators while harming the public and the economy. These groups operate in a space of “existence and non-existence,” where their activities visibly violate the law yet remain well-hidden, creating legal uncertainty. This study employs a qualitative method with a descriptive approach. Data were obtained through interviews and literature reviews, including laws and regulations, court decisions, policies, and other legal sources. The findings reveal that the Land Office of East Jakarta Administrative City combats land mafia practices by digitizing documents, collaborating with law enforcement agencies, and improving public services. However, significant challenges remain, such as structured and organized land mafia operations exploiting regulatory loopholes, limited human resources, and the involvement of corrupt law enforcement officials. Therefore, firm solutions are required, including regulatory reform, capacity building, anti-collusion efforts with law enforcement, and the development of both online and offline complaint services. This research underscores the critical role of the Ministry of ATR/BPN in eradicating land mafia practices to ensure transparent and equitable land governance..
