Abstract

The handling of land disputes in the digital era faces the demand for transforming dispute resolution mechanisms that are more effective, efficient, and adaptive to the development of information technology. Electronic mediation has emerged as one of the instruments introduced through Supreme Court Regulation Number 3 of 2022 as part of the modernization of the judicial system. Nevertheless, its implementation in land dispute cases still encounters various challenges, both normative and practical, particularly related to the complexity of dispute characteristics, institutional readiness, and the limited sectoral regulations in the land administration field. This study aims to analyze the regulatory framework and the practice of electronic mediation in the settlement of land disputes and to formulate the direction for future regulatory development relevant to its implementation at the Yogyakarta District Court and the Yogyakarta City Land Office. The research employs normative legal research using statutory and conceptual approaches. This study is strengthened by field data as supporting material for the analysis. The findings indicate that, normatively, electronic mediation already has a relatively clear legal basis within the judicial environment; however, its effectiveness remains suboptimal, especially in land dispute cases characterized by complex social, juridical, and administrative dimensions. Meanwhile, within the Land Office, electronic mediation has not yet been supported by explicit regulatory provisions, resulting in dispute resolution practices that are still predominantly conventional. This research emphasizes that the successful implementation of electronic mediation is not solely determined by the availability of technology, but also by regulatory alignment, institutional readiness, human resource capacity, and the legal culture of the disputing parties. Therefore, strengthening legal norms, developing operational technical guidelines, and enhancing mediator competencies are necessary prerequisites for the future development of electronic mediation in land dispute resolution.
