Abstract
National food security demands the availability of adequate irrigation infrastructure, including the construction of the Slinga Irrigation Area (DI. Slinga) Irrigation Network in Purbalingga Regency. The implementation of land acquisition for this purpose gives rise to the issue of remaining land, defined as portions of land parcels left over as a result of the primary irrigation channel construction and potentially losing their productive function. This study aims to examine the criteria for remaining agricultural land eligible for compensation and the mechanisms for its resolution. The theoretical foundation is grounded in Law No. 2 of 2012, Government Regulation No. 19 of 2021 in conjunction with Government Regulation No. 39 of 2023, as well as the concepts of justice and legal certainty in land acquisition. A descriptive qualitative method with a case study approach was employed across three affected villages. Data collection was conducted through in-depth interviews, field observation, and documentation study involving land acquisition officers, relevant technical agencies, and remaining land owners. The research results show findings indicate that of 82 identified remaining land parcels, 79 were granted compensation based on criteria encompassing parcel shape, road accessibility, irrigation access, and physical risk of the land. The resolution mechanism consists of nine stages, ranging from notification of construction plans to compensation payment. The primary obstacles include budget constraints, discrepancies in understanding compensation values, and the absence of firm regulations regarding resolution timelines. This study concludes that the resolution of remaining land requires more specific technical criteria, integrated budget planning, and clear time-bound guidelines to ensure legal certainty for entitled parties.
