Abstract
Abandoned land refers to land that is not cultivated, utilized, exploited, and/or maintained in accordance with the purpose for which the land rights were granted, thereby failing to fulfill its social function as mandated by the Basic Agrarian Law. The control and utilization of abandoned land constitute important instruments for ensuring legal certainty, promoting equitable land tenure, and supporting the implementation of agrarian reform. This study aims to examine the mechanism for controlling and utilizing abandoned land, identify the challenges encountered during its implementation, and analyze the solutions undertaken by the Bireuen Regency Land Office, Aceh Province, concerning the former Right to Cultivate (Hak Guna Usaha—HGU) area of PT Peudada Jaya Indah No. 8. This study employed a qualitative research method with an empirical juridical approach. Data were collected through interviews, observations, and document analysis conducted at the Bireuen Regency Land Office, the Regional Office of the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) of Aceh Province, and members of the community occupying the former HGU area of PT Peudada Jaya Indah. The data were analyzed using the Miles and Huberman interactive model, consisting of data reduction, data display, and conclusion drawing. The findings indicate that the mechanism for controlling abandoned land has been implemented in accordance with Government Regulation Number 48 of 2025 and the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 20 of 2021. The process includes land inventory, evaluation, issuance of warning letters, designation of abandoned land, and its subsequent determination as State General Reserve Land (Tanah Cadangan Umum Negara—TCUN). Furthermore, the land utilization process is carried out through the Inventory of Land Tenure, Ownership, Use, and Utilization (Inventarisasi Penguasaan, Pemilikan, Penggunaan, dan Pemanfaatan Tanah—IP4T), which serves as the basis for its implementation. Nevertheless, the implementation of land utilization has not yet been fully optimized due to several constraints, including discrepancies between administrative records and actual field conditions, limited human resources and budget allocation, weak inter-agency coordination, low levels of public trust, long-term de facto occupation of land by local communities, and overlapping land tenure claims. To address these issues, the Bireuen Regency Land Office has strengthened cross-sectoral coordination, implemented IP4T activities, improved land administration data, and intensified public outreach and socialization programs. The successful control and utilization of abandoned land depend not only on the existence of an adequate regulatory framework but also on strong institutional capacity, accurate land information, effective inter-agency coordination, active community participation, and sufficient resources to ensure the sustainable achievement of agrarian reform objectives.
