Abstract

Transmigration land possesses unique characteristics because it is allocated by the state as part of programs aimed at population redistribution, improving the welfare of transmigrants, and regional development. Due to this unique status, the transfer of rights to transmigration land cannot be executed freely; instead, it must comply with specific legal provisions, mandatory guidance periods, and prohibitions on transfer. However, in Brabasan Village (Tanjung Raya District, Mesuji Regency), instances of informal ("under-the-table") transfers of transmigration land rights are still found—conducted via simple receipts, written declarations, verbal agreements, or merely with the knowledge of village officials. This study aims to analyze the legal provisions governing the transfer of transmigration land rights, the factors driving these informal transfers, and the roles of the Land Office and local government in addressing the issue. The study employs a socio-legal (empirical-juridical) method with a qualitative approach. Data were gathered through interviews, field observations, and literature reviews, then analyzed using data reduction, data presentation, and conclusion drawing. The findings indicate that informal transfers of transmigration land hinder the optimal achievement of the transmigration program's objectives, particularly regarding transmigrant welfare and the maintenance of orderly land administration. Such practices create legal uncertainty due to discrepancies between physical possession on the ground and the legal data recorded in land administration systems. Consequently, the issue cannot be viewed merely as a matter of public non- compliance with the law; these informal transfers also reveal weaknesses in the guidance, supervision, and protection provided to the transmigrant community. Therefore, resolving the issue requires more than just raising legal awareness; it necessitates the regularization of land data, strengthened inter-agency coordination, and sustained supervision.
