Abstract

Land mafia practices constitute one of the most serious crimes in the land sector because they threaten legal certainty over land rights through document forgery and unlawful transfer of ownership. This study aims to analyze: (1) whether the application of the elements of criminal offense in Decision Number 248/Pid.B/2022/PN.Jkt.Brt is consistent with criminal law doctrine; (2) whether the judges' legal considerations reflect the principles of legality and legal certainty; and (3) the role of the West Jakarta Land Office in handling land mafia practices. This research employed a qualitative method using a normative juridical approach with statutory and case approaches. The research data consisted of primary legal materials, including legislation and the criminal court decision, supported by interviews and secondary legal materials obtained through literature studies. Data were analyzed descriptively and qualitatively The results indicate that the application of the elements of criminal offense in the decision is consistent with criminal law doctrine. The defendants' actions fulfilled the elements of document forgery under Article 264 paragraph (1) in conjunction with Article 55 paragraph (1) of the Indonesian Criminal Code (KUHP), and were classified as formal offenses, commission offenses, intentional offenses (dolus), and ordinary offenses. Furthermore, the judges' legal reasoning reflected the principles of legality and legal certainty because the conviction was based on valid legal provisions, supported by lawful evidence, and provided legal protection for the injured parties. The study also found that the West Jakarta Land Office plays an important role in preventing and handling land mafia practices through administrative supervision, provision of land data, implementation of court decisions, coordination with law enforcement agencies, and improvement of land administration to strengthen legal certainty over land rights Keywords: Land Mafia, Crimal Decision, Land Law, Legal Certainty
