Abstract

The construction of the Yogyakarta-Kulon Progo Toll Road National Strategic Project (PSN) requires large-scale land acquisition, resulting in the emergence of residual land, which is land not included in the development route but experiencing a decline in function, accessibility, and economic value. Although regulated by Law Number 2 of 2012 and its implementing regulations, the mechanism for resolving compensation for residual land in practice still faces various administrative, technical, and coordinative obstacles that have the potential to hinder the protection of community rights. This study aims to analyze the implementation practices for resolving compensation for residual land in the National Strategic Project (PSN) in Sleman Regency, assess the effectiveness of the settlement mechanism, and identify obstacles encountered during the implementation process. The study used qualitative methods with an empirical juridical approach. Primary data were obtained through in-depth interviews with officials from the Sleman Regency Land Office, members of the Land Acquisition Implementation Team, agencies requiring land, and village officials in the affected areas. Secondary data were obtained through a literature review of laws and regulations, official documents, and literature related to land acquisition and residual land. Data analysis was conducted using descriptive qualitative methods, including data collection, data reduction, data processing, data presentation, conclusion drawing, and recommendation development. The results indicate that the mechanism for resolving residual land compensation has been implemented through the provision of compensation in accordance with statutory provisions. A total of 49 residual lands were identified in the three villages, with 5 having received compensation due to their area being less than 100 m2, and 44 remaining lands not yet receiving compensation due to their area exceeding 100 m2 and requiring further feasibility studies. In terms of effectiveness, this mechanism has achieved its goal of protecting community rights and providing benefits in the form of restoration of unusable residual land. However, its effectiveness is not optimal due to delays in completion, the lack of uniform technical criteria for determining eligible residual land for compensation, and challenges in inter-agency coordination and administrative completeness. Therefore, improvements to technical guidelines, strengthening coordination between relevant parties, and accelerating the administrative process are needed to improve legal certainty, implementation effectiveness, and protect community rights in resolving residual land compensation for National Strategic Projects.
