Abstract
The construction of Cibeet Dam as a National Strategic Project requires land acquisition, which in its Implementation has encountered overlapping claims between land controlled by communities based on hereditary possession and land that has been registered with Building Use Rights (HGB). This study aims to analyze the implementation of land acquisition, the factors causing overlapping claims, and the resolution efforts in the Cibeet Dam Project. This research uses an empirical juridical method with a qualitative approach through interviews, field observations, documentation studies, and analysis of relevant regulations. The results show that overlapping claims occur due to differences between physical and juridical data, historical community land control, and differences in proof of rights between customary evidence and HGB certificates. The resolution is carried out through data verification, deliberation, and examination by the Land Acquisition Committee by considering legal certainty and justice. In Kutamekar Village, the resolution was successfully achieved through mediation, while in Cariu Village, it is still at a deadlock.
