Abstract

This research examines the implementation of Electronic Mortgage Rights Services (HT-el) and Electronic Roya Services (Roya-el) at the Land Office of Bantul Regency. HT-el and Roya-el are part of the digital transformation of land administration services aimed at improving legal certainty, service speed, and accessibility. However, their implementation still faces regulatory and technical- operational challenges. This study aims to analyze the potential for inconsistencies between basic and technical regulations, identify weaknesses in service implementation, and formulate strategies to strengthen HT-el and Roya-el services in the future. This research uses a qualitative method with empiricial juridical approach. Data were collected through regulatory document studies, interviews, observations, and questionnaires involving the Land Office, Land Deed Officials (PPAT), banks, community members, and academics. The data were analyzed using content analysis to examine normative issues and descriptive qualitative analysis to identify implementation weaknesses in the field. The results show that regulatory inconsistency is not found in the form of direct normative conflict, but rather as an implementative inconsistency between basic land regulations and technical regulations for electronic services. This inconsistency appears in three aspects: document submission, service issuance time, and the division of responsibilities among the parties involved. The weaknesses in HT-el and Roya-el implementation are more dominant in technical- operational aspects, including workload pressure, complaint response, technical training, consistency in rule application, system disruptions, data validation, inter-actor coordination, and transparency in file correction. The strengthening strategy is directed into two approaches: normative strengthening and implementation strengthening. Normative strengthening focuses on clarifying electronic document standards, the basis for service issuance, and the division of responsibilities among parties. Meanwhile, implementation strengthening focuses on improving organizational capacity, human resources, regulatory application, information technology and databases, and business processes.
