Abstract

Land registration aims to provide legal certainty through the presentation of complete physical and juridical data. However, the land registration system has primarily focused on the recording of Right, while land use and utilization Restriction have not been optimally recorded in land books or land certificates. This condition creates a gap between the normative provisions governing land use Restriction and their implementation in land administration practices. This study aims to identify and classify the types of land use and utilization Restriction and to analyze the implementation of policies concerning their recording at the Bima City Land Office. This research employed a descriptive qualitative approach. Data were collected through interviews, document studies, and observations of land administration processes at the Bima City Land Office. The analysis was conducted using the framework of Right, Restriction, and Responsibility (3R), land registration regulations, and legal provisions related to spatial planning and the protection of specific areas. The results indicate that land use and utilization Restriction can be classified into two categories: Restriction that should be recorded and Restriction that do not require recording. Restriction that should be recorded are specific and directly attached to particular land parcels, such as protected areas, disaster-prone areas, and areas subject to special controls. In contrast, general and normative Restriction, such as the social function of land, do not require individual recording because they apply universally through statutory regulations. The study also found that the recording of land use and utilization Restriction at the Bima City Land Office has not been fully implemented in accordance with Article 90 of PMNA/KBPN Regulation Number 3 of 1997. Although restriction information is considered during the land Right granting process, it is generally not recorded in detail in land books or certificates.
