Abstract

Land conflicts over former Land Use Rights (HGU) are a common form of land conflict in Indonesia due to the expiration of the HGU period without legal certainty and restructuring of land ownership and utilization. One such conflict occurred between PT. Rotorejo Kruwuk and the community members of the Kelud Makmur Farmers Association (PPKM) in Gadungan Village and Sumberagung Village, Gandusari District, Blitar Regency. This study aims to analyze the factors underlying the occurrence of land conflicts over former HGU, analyze the process and mechanisms of conflict resolution based on Law No. 5 of 1960, Government Regulation No. 18 of 2021, and Regulation of the Minister of ATR/BPN No. 21 of 2020, and analyze the role and effectiveness of the Blitar Regency Land Office in resolving the conflict. This study uses a qualitative research method with a descriptive empirical approach. Research data were obtained through interviews, observations, and literature studies, then analyzed using data reduction, data presentation, and conclusion drawing techniques. The results of this study indicate that the conflict was influenced by delays in the extension of the HGU (HGU) rights, differences in interpretation of the legal status of the land after the HGU expired, the leasing of some land to third parties after the HGU expired, and community dissatisfaction with land redistribution and the determination of the subjects and objects of land redistribution recipients. Conflict resolution was carried out through coordination meetings, mediation, the designation of conflicting locations for former HGU land as Priority Locations for Agrarian Reform (LPRA), and plans for the release of some land by the company. However, this resolution process has not been fully effective due to ongoing conflicts between community groups, differing interests, and the limited authority of the Land Office, which only acts as a facilitator and mediator. Therefore, strengthening inter-institutional coordination, increasing legal certainty, and transparently determining the subjects of land redistribution are needed to ensure effective and fair resolution of conflicts over former HGU land.
