Abstract

Mediation is a non-litigation mechanism for resolving land disputes that emphasizes deliberation between disputing parties with the assistance of a neutral mediator. This study aims to identify the factors causing the failure of mediation in resolving land disputes at the Ternate City Land Office, and to formulate efforts to improve the role of mediation so that it can run more effectively. This research is an empirical legal study using a descriptive qualitative approach. Data were obtained through interviews, observation, and document study of five land dispute cases selected through purposive sampling, and were then analyzed using data triangulation. The results show that of the 137 land complaint cases recorded during the 2015–2025 period, only 5 cases, or approximately 3.64%, were successfully resolved through mediation, while the remaining 132 cases proceeded to litigation. This failure was caused by external factors, namely the absence and low good faith of the parties, an egoistic attitude in defending rights, communication and distance constraints, and incomplete supporting data; as well as internal factors, namely limited human resources and the absence of certified mediators. This study recommends increased mediation outreach down to the village level, strengthening the mediator's persuasive approach, increasing mediator certification, developing electronic mediation, and strengthening land data coordination to improve the effectiveness of mediation.
