Abstract

This study examines the land acquisition process for the construction of permanent housing following the 2024 eruption of Mount Ruang in Modisi Village, Pinolosian Timur District, South Bolaang Mongondow Regency. The study aims to analyze the implementation of land acquisition stages, the dynamics of stakeholder interactions, emerging obstacles, and the fulfillment of the principles of legal certainty, justice, and community participation. The method used is descriptive qualitative with data collection techniques through interviews, observation, documentation, and document studies. The results show that the land acquisition stages, including planning, preparation, implementation, and handover of results, have been normatively implemented in accordance with statutory provisions, although there are procedural adjustments due to the post-disaster emergency conditions. Stakeholder dynamics are running relatively well through coordination between the local government, the Regional Office of ATR/BPN, the Land Office, village governments, landowners, and affected communities. The main obstacles identified include legal issues related to compensation for losses in coastal areas and the socio-economic vulnerability of the community after relocation. From a legal certainty perspective, land acquisition has demonstrated strong progress, with the issuance of most land title certificates to permanent housing recipients. However, aspects of justice and participation still need to be strengthened, particularly in livelihood restoration and substantive community involvement.
