Abstract
This study examines the implementation of the Fishermen’s Land Certification Program in the coastal area of Kubu Village, Kumai Subdistrict, West Kotawaringin Regency, Central Kalimantan Province. This program was implemented as part of the government’s efforts to provide legal certainty regarding land tenure for fishing communities that have long resided in coastal areas. However, coastal areas are protected zones where land use is restricted. The objective of this study is to analyze the legal framework governing the granting of land rights in coastal areas and to examine the implementation of the Fishermen’s Land Certification Program in Kubu Village. This study employs a qualitative method with a descriptive-legal approach. Data were collected through interviews, observations, document analysis, and a literature review, and were subsequently analyzed using data reduction, data presentation, and conclusion-drawing techniques. The results indicate that the granting of land rights is governed by regulations in the fields of land administration, spatial planning, and coastal zone management. Program implementation begins with the identification of potential beneficiaries and locations, followed by the collection of physical and legal data, verification and determination of land rights, and concludes with the issuance of electronic certificates. Land parcels located within the coastal zone are granted a Right of Use, while land parcels outside the coastal zone are granted a Right of Ownership in accordance with applicable laws and regulations. This program provides legal certainty for fishing communities while maintaining the protective function of coastal areas through the application of spatial planning and environmental protection principles. This study recommends the need to improve the implementation of the Fishermen’s Land Certification Program through the consistent application of land registration and spatial planning regulations to strengthen legal certainty and preserve the protective functions of coastal areas, as well as to strengthen coordination among agencies so that implementation can proceed effectively, sustainably, and in accordance with applicable laws and regulations.
