Abstract

The background of the staudy is agrarian conflict at Jenar village. This study purposes is to analyse the reason of land dispute involving overlapping community’s land certificate with village’s land asset certificate as well as the effort from all disputing group to solve the problem. The study has done not only to know who the winner or loser but also to examine the cause of land administration problem and to test the certificate validity as a law product fairness. The method used is empiric law with qualitative descriptive approach to examine the neutral law application among the conflict of the owners’ land certificate claiming involving the community and the government as nation representation. The study is a case study on certificate land overlapping dispute in Jenar, Sragen district. The result of the study indicates that the overlapping is caused by data asynchrony owned by the community and the village government at the time of land registration at BPN (Agraria Department). The conclusion of the study is chronologically the overlapping land certificate start with village’s land certificate publication, after that all the disputing group tried to pursue non-litigation to solve the problem but it failed to get any agreement, finally the community pursued the ligitation by suing legal action in judicial institution.
