Abstract
Land acquisition for public infrastructure development frequently gives rise to disputes, particularly concerning the amount of compensation offered to affected landowners. This study aims to analyze the factors causing compensation value disputes, examine the dispute resolution mechanisms implemented, and evaluate their effectiveness in providing legal certainty and justice for communities affected by the construction of the Sigli–Banda Aceh (SIBANCEH) Toll Road in Aceh Besar Regency. This study employed a qualitative approach and was conducted in Blang Bintang, Kuta Baro, and Indrapuri Districts. Informants were selected purposively from parties involved in the land acquisition process, including officials of the National Land Agency, land appraisers, village authorities, community leaders, affected landowners, and landowners whose compensation was deposited with the court. Data were collected through semi-structured interviews and document analysis and were subsequently analyzed thematically. The results indicate that compensation value disputes were caused by multidimensional factors. The primary factor was the discrepancy between the compensation value determined by the Public Appraisal Services Office and the value considered appropriate by the community. Other contributing factors included the loss of the land’s productive and economic functions, limited information regarding the basis of valuation, differences in compensation between adjacent plots, and differing interpretations of the purpose of deliberation. Dispute resolution was implemented gradually through deliberation, negotiation or persuasive approaches, submission of objections to the District Court, and court deposit of compensation. Of the 1,322 affected land parcels, 1,289 were resolved through the transfer of acquisition results, while 33 parcels were resolved through court deposit. These mechanisms were relatively effective in providing legal certainty but had not fully achieved procedural and substantive justice. Therefore, greater transparency in valuation, participatory deliberation, livelihood restoration, and the use of court deposit as a last resort are required. Keywords: compensation value dispute, land acquisition, SIBANCEH Toll Road, court deposit, legal justice.
