Abstract

This study aims to analyze the role and function of customary justice in resolving land disputes and to examine the strategies of the Banda Aceh City Government in optimizing its implementation. The research employed a qualitative descriptive approach. Data were collected through semi-structured interviews, observations, documentation, and literature review. The informants included representatives of the Aceh Customary Council (Majelis Adat Aceh/MAA), village officials, customary leaders, community members involved in land disputes, and the Banda Aceh Land Office. Data were analyzed using the interactive model of Miles and Huberman, consisting of data reduction, data display, and conclusion drawing. The findings indicate that customary justice remains the primary mechanism for resolving land disputes through deliberation and mediation based on kinship values and social harmony. The Keuchik, Tuha Peut, Mukim, and the Aceh Customary Council play complementary roles in the dispute resolution process. The most common disputes involve land boundaries, inheritance, and land ownership caused by weak land administration. Although customary justice provides a simple, accessible, and peaceful dispute resolution mechanism, it is limited because it has no legal authority to determine formal land ownership rights. Optimizing its function requires strengthening the capacity of customary institutions, improving regulations, enhancing inter-institutional coordination, increasing public awareness of land administration, and improving the documentation of customary dispute settlements.
